The following Terms and Conditions govern the use of the YourEnergyCode.com service, operated by:

1. Contract Partner, Conclusion of Contract

The purchase contract is concluded with ABeffekt GmbH. A contract is concluded when you click the order button (“Check”). Immediately after submitting your order, you will receive a confirmation by email.

A binding contract may also be concluded earlier as follows:

  • For payment by credit card: upon charging the credit card.
  • For payment by PayPal: upon confirmation of the payment instruction to PayPal.
  • For payment by Sofort transfer: upon confirmation of the payment instruction to Sofort GmbH.
  • For payment by Giropay: upon confirmation of the payment instruction to Giropay.

2. Registration

Using the YourEnergyCode.com service requires free registration. You will need to provide an email address, your date of birth, and your first and last name. Alternatively, this data may be imported via “One-Click Registration” through Facebook, if such functionality is offered.

By registering, a free membership agreement is created. You will receive a confirmation email with the contract data and the Terms and Conditions valid at the time of registration. These can be saved or printed. The contract data will be stored by us.

Before concluding a paid contract, you will be informed about the contents, prices, and payment terms.

3. Use

To use the service in full, up-to-date browsers should be used (e.g., with JavaScript and cookies enabled). Older technologies may result in limited functionality.

YourEnergyCode.com reserves the right to temporarily suspend the service, for example for maintenance work or due to force majeure.

The customer assures that all information provided is true. Use must not violate applicable law or the rights of third parties.

No content (texts, images, software, etc.) may be uploaded without the corresponding usage rights.

The underlying mechanism of YourEnergyCode.com is a trade secret and calculates matches using dozens of methods. Despite efforts to ensure accuracy, no guarantee can be given for conformity with reality.

The customer is responsible for the content they provide, publish, or transmit. YourEnergyCode.com accepts no liability for user content. When publishing images of third parties, you confirm that you have obtained their consent.

4. Payment

Fees are due in advance and payable immediately. Unless otherwise agreed, no refunds will be given.

Payment methods:

  • Credit card: charged upon completion of the order.
  • PayPal: payment via your PayPal account.
  • Invoice (if offered).
  • Sofort transfer: payment via the secure form of Sofort GmbH.
  • Giropay: online transfer using your bank’s PIN/TAN.

5. Data Use and Disclosure

YourEnergyCode.com complies with the applicable data protection regulations, in particular the BDSG, TMG, and GDPR. For details, please refer to our Privacy Policy.

6. Termination of Free Membership

You may cancel your membership at any time in text form (e.g., letter, email). Users with Facebook Connect may also cancel via their Facebook profile.

7. Warranty and Liability

YourEnergyCode.com is liable only for damages caused intentionally or by gross negligence, as well as for injury to life, body, or health.

In other cases, liability is limited to typical, foreseeable damages. Any further liability is excluded.

The above limitations of liability also apply to vicarious agents and employees of YourEnergyCode.com.

Liability under the Product Liability Act or in cases of fraudulent intent remains unaffected.

8. Storage of Contract Text

We store the contract text and send you the order data and our Terms and Conditions by email. Your previous orders are not accessible online for security reasons.

9. Contract Language and Changes to the Terms

The contract languages are German and English.

YourEnergyCode.com reserves the right to amend these Terms and Conditions with effect for the future, provided that the essential contractual provisions are not affected and the amendment is necessary due to legal, judicial, or market-related developments.

When we change the Agreement, we will update the “last revised” date at the top of this page. You should frequently review this Agreement and all applicable terms and policies to understand the terms that apply to your use of the Services. If you do not agree to the amended terms, you must stop using the Services.

2. Use of the Service

  1. You agree that you will only use the Service, including the posting of any content through the Service, in a manner consistent with this Agreement and any and all applicable local, state, national and international laws and regulations. Use of the Service is void where prohibited.
  2. You take not of that the matching algorithm we use on our Website is our Trade Secret. We make every effort to do this algorithm as accurate as it possible, however we can not guarantee, that the results will always reflect the reality. Please be aware, that the algorithm take into account only certain information about users.
  3. YourEnergyCode does not make any representations, warranties or guarantees as to the conduct of its users, information provided by users, or their compatibility with you.
  4. You assume all risk when using the Services, including but not limited to, all risks associated with any online or offline interactions with others, including dating. You agree to take all necessary precautions when meeting other users, especially if you decide to meet in person.

3. Responsibility for User Content

  1. You are solely responsible for the content and information that you provide, publish or transmit to our Service, including without limitation data, text, photos and graphics. YourEnergyCode does not control, take responsibility for or assume liability for any User Content posted by you, nor is YourEnergyCode liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you encounter. Please note, that you are solely responsible for your use of our Service and use them at your own risk.
  2. When placing images of third-parties, you declare that you have the consent of that person to use the image on our site. You will not post or transmit any User Content that violates any third-party rights or any applicable law, rule or regulation or is prohibited under this Agreement.

4. Accuracy of Information

  1. Please note, that providing accurate information is a prerequisite for correct operation our algorithm.
  2. You will not post any inaccurate, misleading, incomplete or false information to our Service. You agree, that all images You provide are of you and were taken within the last 2 years.

5. Technical requirements

  1. Minimum (recommended) technical requirements of the Users computer system to use the Site:
  • CPU 1000 MHz;
  • RAM: 512 MB;
  • Internet connection;
  • Browser: Internet Explorer 8.0, Firefox 3.6, Opera 9.0 or later, respectively;
  • Cookies enabled;
  • Plugin Flash 9.0, or later, respectively;
  • JavaScript enabled.

6. Privacy

  1. Please refer to our Privacy Policy for information about how we collect, use, store and disclose personally identifiable information from its users. You understand that by using the Service you consent to the use of your personally identifiable information and aggregate data as set forth in our Privacy Policy, and to have your personally identifiable information collected, used, transferred to and processed in the United States or any other country in which we process your data or make the Service available.
  2. You also consent to receive emails from us in connection with the use or promotion of the Service.

7. Links To Other Web Sites

  1. Our Service may contain links to third-party web sites or services that are not owned or controlled by YourEnergyCode.

8. Termination

  1. We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation, if you breach the Terms.
  2. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

9. Claims and complaints

  1. Any complaints relating to the provision of the YourEnergyCode by the Operator, as well as questions regarding the use of the Service, should be addressed to the e-mail address office@abeffekt.com or to the mailing address:

  2. The complaint letter should contain: name and surname, the exact address of seat or residence (optionally the mailing address), the e-mail address provided during the use of the Service, and a detailed description and reason of the complaint. We refuse to consider any complaints resulting from non-compliance with the Regulations.
  3. The operator shall consider the complaint within 7 business days from the date of its reception and shall immediately inform the User by e-mail as to how it is to be dealt with. The consideration of the complaint by the Operator shall be considered final.

10. Changes

  1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
  2. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Under no circumstances will YourEnergyCode be responsible for any loss, damage or harm of any kind resulting from any user conduct or from anyone’s reliance on information or other content posted on the services, or transmitted to or by any users.

Some countries and jurisdictions do not allow the disclaimer of implied warranties and terms in contracts with consumers and as a result the contents of this section may not apply to you.

Limitation of liability

To the maximum extent permitted by law, in no event shall YourEnergyCode, its affiliates, directors, members, employees or agents be liable for any special, consequential or indirect damages, including but not limited to loss of use, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or relating to the use of or inability to use the services, or the proprietary materials contained in or accessed through the service, including without limitation any damages caused by or resulting from reliance by user on any information obtained from YourEnergyCode, or that results from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of god, communications failure, theft, destruction or unauthorized access to our records, programs or services.

To the maximum extent permitted by applicable law, in no event shall YourEnergyCode be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the services, including without limitation, bodily injury, emotional distress, identity theft and/or any other damages resulting from communications, meetings or other interactions with other users of the services. this includes any claims, losses or damages arising from the conduct of users who have registered under false pretenses or who attempt to defraud or harm you.

Some countries and jurisdictions do not allow the limitation or exclusion of liability in contracts with consumers and as a result the contents of this section may not apply to you.
